How Does the Short Sale Process Work?

A short sale is accomplished by negotiating with the bank for a short payoff of the amount owed on your home’s mortgage. A good Real Estate Agent will walk you through the process and handle all negotiations with the bank on your behalf. Most banks require a “Short Sale Package” be submitted with an offer to purchase the property detailing your current financial situation and explaining the hardship that has necessitated the sale of your home. This “package” usually contains your most recent bank statements, pay stubs, a complete financial worksheet (essentially your household budget) and the last two years’ tax returns. The bank uses these documents to determine whether they should agree to release the lean on your home short of what’s owed. Short Sales are becoming very common as the economic downturn has sucked most of the equity out of our homes, but not every Realtor is experienced in this type of transaction so choose carefully. Be sure to look for a detailed list of documents the agent wants to see up front so they can begin putting the “package” together immediately upon listing your house for sale. You don’t want to be scrambling to gather these documents when an offer comes in – it only unnecessarily delays the already lengthy process. Also, ask the agent to tell you about the strategies they use to get an offer quickly and control the short sale process as it goes through the various steps of bank approval. If they don’t have a good answer that makes sense to you, keep shopping for another agent.

If done correctly, a short sale can be the best way out of a suffocating house payment with the fewest consequences. Many lawyers and accountants are now advising homeowners to short sale their homes instead of letting it go to foreclosure because of the power you maintain through the process. When negotiating with the bank, you have the most control over how it’s reported on your credit, whether there will be a note for the deficiency and when you have to move. If you just let it go back to the bank, you have no say in anything.
